Community Program Terms
Dunieski Designs ("Dunieski Designs," "we," "us," or "our") is a brand and web design studio operated by Dunieski Enterprises LLC in Tampa, Florida. Through our Community Program, we take on select projects for small local businesses and nonprofits for free or at a reduced cost.
These Community Program Terms ("Program Terms") explain who can apply, how projects are chosen, and what we ask in return. By submitting an application, you agree to these Program Terms. If you are selected, our Terms of Service and Privacy Policy also apply. If these Program Terms conflict with the Terms of Service, these Program Terms control for Community Program projects.
1. About the program
- The Community Program runs from November 1, 2026 to November 1, 2028, unless we end it sooner or extend it. Applications received outside these dates will not be considered.
- The Community Program is offered at our sole discretion. We do not commit to a set number of projects, a schedule, or any timeline for reviewing applications.
- We may pause, change, or end the program at any time, including while applications are open.
- Applying is free. Applying does not guarantee selection, a response by any date, or any particular service.
2. Who can apply
To be eligible, the business or organization applying (the "Applicant") must meet all of the following:
- Small business. The Applicant has 10 or fewer people working in the business, counting owners, employees, and regular contractors. Part-time workers count as one person each.
- Revenue. The Applicant's gross annual revenue is under $250,000. Nonprofits are measured by annual operating budget instead.
- Independently owned, no franchises. The Applicant is locally owned and operated. Franchises and franchisees, subsidiaries, and businesses owned or controlled by a larger company are not eligible.
- Local. The Applicant is based in Tampa, Florida.
- Legally operating. The Applicant is legally registered and holds any licenses its work requires. Nonprofits must be registered with the State of Florida or recognized as tax-exempt by the IRS.
- Authorized applicant. The person applying is at least 18 years old and is an owner, officer, or person authorized to make decisions for the Applicant.
- Never a paying client. The Applicant, and its owners, have never paid us for services.
Businesses we do not accept
We do not take on Community Program projects for businesses or organizations involved in:
- Adult content or adult entertainment
- Gambling or betting
- Tobacco, vaping, cannabis, or alcohol as the primary product
- Firearms, ammunition, or weapons
- Political campaigns, political parties, or political action committees
- Multi-level marketing
- Payday lending, debt collection, or similar high-interest lending
- Content or activity that promotes hate, harassment, or violence
- Anything illegal under federal, state, or local law
We may decline any application for any reason, even if it meets every requirement above, and we are not required to explain a decision.
3. Applying and selection
- Apply through the form on our Community page. We may ask for more information, a short call, or proof of eligibility (for example, a business registration, a nonprofit determination letter, or a statement of employee count or revenue).
- We choose projects based on need, potential impact on the business and community, how well the project fits our services, and our available capacity.
- We read every application, but we only contact Applicants we are able to move forward with.
- If you are not selected, you may apply again after 6 months.
- If an Applicant gives false or misleading information, we may reject the application or end a project at any time.
4. The project
- Written agreement. Every selected Applicant must sign our Community Project Agreement before any work begins. It lists the services, deliverables, timeline, any cost, and the publicity rights described in Section 6. No work starts until it is signed by both sides, and only what is written in it is included.
- Free or reduced cost. A project may be free or offered at a reduced price. The agreement will state which. Any reduced price is due as the agreement describes.
- Scope. We decide the scope of each Community Program project. Work outside the agreed scope, or extra revision rounds, may be offered at our standard rates.
- Third-party costs. Unless the agreement says otherwise, the Applicant pays for outside costs such as domain names, website hosting, email accounts, printing, stock photos or fonts, software subscriptions, and advertising spend. These accounts will be in the Applicant's name.
- Same standards. Community Program projects follow the same process and quality standards as our paid work.
5. What we need from you
- Provide accurate information, content, photos, logos, and feedback when we ask for them.
- Respond to our messages within 3 business days. If we receive no response within 5 calendar days of a message, the project may be terminated.
- Only send us materials you own or have permission to use. You are responsible for any content you provide.
- Treat our team with respect. We may end a project if communication becomes abusive or unreasonable.
6. Portfolio, publicity, and testimonial
Community Program projects are offered in exchange for the right to show the work. By accepting a project, the Applicant agrees that:
- Portfolio and publicity use. We may use the Applicant's name, logo, branding, website, and before-and-after images, along with the work we create, in our portfolio, on our website, on social media, in case studies, in presentations, in advertising, and in other marketing and publicity, during and after the project. The signed Community Project Agreement grants this permission in writing.
- Testimonial. The Applicant will provide an honest written or video testimonial within 30 days of project completion. The testimonial must reflect the Applicant's real experience. It does not have to be positive.
- Disclosure. When we share a Community Program testimonial or case study, we will note that the work was done through our Community Program at no cost or a reduced cost.
- Likeness. We will only use a person's face, voice, or name as an individual with that person's written consent.
- Sensitive details. We will not publish private business information such as finances, customer data, or account logins.
The Applicant may ask us to stop using its name in new marketing materials after the project ends. Materials already published or printed do not have to be removed.
7. Ownership
- Once a project is complete and any amount due is paid, the Applicant owns the final deliverables as described in our Terms of Service.
- We keep ownership of drafts, unused concepts, our templates, tools, code libraries, and working files, as well as the right to show the work as described in Section 6.
8. Value of services
- Community Program services have no cash value and cannot be exchanged for money, credit, or other services.
- Selection is not transferable to another business, owner, or location.
- The Applicant is responsible for any tax effects of receiving free or reduced-cost services and should ask its own tax advisor.
9. Ending a project
- Either side may end a Community Program project with written notice (email is fine).
- If a project ends before completion, we will deliver any finished deliverables that are ready, unless the project ended because of false information or a breach of these Program Terms.
- If the Applicant was charged a reduced price, any refund for unfinished work is handled as described in the project agreement.
- Sections 6, 7, 8, and 10 continue to apply after a project ends.
10. No guarantees
We will do our best work, but we do not guarantee any particular result, such as more customers, sales, search rankings, or social media growth. Our total responsibility for any Community Program project is limited as described in our Terms of Service and will not exceed the amount the Applicant paid us for that project.
11. Changes to these Program Terms
We may update these Program Terms from time to time. The "Last updated" date at the top shows the latest version. Changes do not apply to a project already covered by a signed project agreement unless both sides agree.
