Privacy Policy
Dunieski Enterprises LLC, doing business as Dunieski Designs ("Dunieski Designs," "we," "us," or "our"), is a brand and web design studio based in Tampa, Florida. This Privacy Policy explains what information we may collect, how we may use and share it, and the choices you have. It applies to dunieskidesigns.com, its subdomains, our client portal, and any related pages, forms, emails, calls, messages, social media accounts, and services (together, the "Services").
We would rather tell you about everything we might collect than leave something out. Some of the categories below describe tools or features we may not use at all times. Where a category is listed, it means we may collect or use that type of information, not that we always do.
This policy does not cover information we handle on behalf of our clients, such as leads collected through a client's website or forms. That information is governed by our client's own privacy policy, and we handle it only to provide services to that client.
This policy describes our practices. It is not a contract. If you do not want your information handled as described here, please do not use the Services.
1. Information we may collect
Information you give us
- Contact details: your name, email address, phone number, business name, job title, website address, mailing address, and social media handles.
- Messages and requests: anything you send through our contact form, free brand audit form, Community Program application form, FAQ question form, email, text message, WhatsApp, social media messages, or other channels.
- Scheduling details: information you provide when booking a consultation through a scheduling service, such as your name, email, time zone, and answers to booking questions.
- Project information: details about your business, goals, audience, competitors, and preferences, along with files, logos, photos, videos, text, brand assets, account access details you choose to share for project work, and feedback you provide.
- Client portal information: your email address, login activity, and the project records we create for you, such as project names, status, progress, milestones, updates, and links.
- Payment and billing information: your name, billing address, email, and details about your purchases and subscriptions. Card and bank details are entered directly with our payment processors (such as Stripe or Square) and are handled by them. We do not store full card numbers.
- Testimonials and reviews: feedback you give us, which we will only publish with your permission.
- Call and meeting information: notes we take during calls or meetings. We will only record a call or meeting, including with an AI note-taking tool, with the permission of everyone on it.
- Likeness and voice: photos, video, or audio of you, provided for project work such as AI video marketing. We will only use a person's face or voice with written consent. See "Face and voice data" in Section 3.
Please do not send us Social Security numbers, bank account numbers, health information, or passwords unless we specifically ask for them. When we need access to one of your accounts, we prefer that you add us through that platform's user or team features.
Information collected automatically
When you visit the Services, we and the service providers we use may automatically collect:
- Device and browser information: IP address, browser type, operating system, device type, screen size, and language settings.
- Usage information: pages viewed, links clicked, time spent on pages, referring websites, and the date and time of your visit.
- Interaction information: how you interact with pages, such as clicks, scrolling, and mouse movement. Some analytics tools can record these interactions as a replay of your visit.
- Approximate location: general location (such as city or region) inferred from your IP address.
- Log information: technical records kept by our hosting, database, and security providers to run and protect the Services.
- Email interaction information: whether an email from us was opened or a link in it was clicked, if our email tools support this.
Preferences saved on your device
The Services may save small pieces of information in your browser, using cookies, local storage, or similar technology, to remember your choices. These may include:
- Language preference (English or Spanish).
- Display preference (light mode, dark mode, or following your device's setting).
- Login session for the client portal, so you stay signed in.
- Form and consent choices, such as whether you have accepted or declined optional cookies.
These preferences stay on your device. You can clear them at any time in your browser settings.
Information from other sources
We may receive information about you from:
- Scheduling, payment, hosting, form, email, and analytics providers we use.
- Social media platforms, when you interact with our accounts or ads.
- Referrals, when someone recommends our Services to you.
- Publicly available sources, such as business websites, public business listings, social media profiles, and public professional license records, when preparing a brand audit or proposal you requested, or to find businesses that may be interested in our Services.
- Data providers and business directories that supply business contact information.
- Partners who help us find and contact potential clients.
Business contact information
If you are a real estate professional or other business owner, we may collect your business contact information, such as your name, brokerage or company, business phone number, business email, website, social media profiles, and professional license details, from public sources and data providers. We use it to contact you about our Services. You can ask us to stop contacting you at any time (see Section 9).
2. Cookies, analytics, and similar technologies
We may use cookies, pixels, local storage, and similar technologies to:
- Keep the Services working and secure.
- Remember your preferences, such as language and light or dark mode.
- Keep you signed in to the client portal.
- Understand how visitors use the Services so we can improve them.
- Measure the performance of our marketing and advertising.
We may use analytics services such as Plausible, Google Analytics, or similar tools. Some of these tools may use cookies and may collect information about your activity across websites over time. We may also use advertising or social media pixels (for example, from Meta or Google) to measure ads.
Cloudflare Web Analytics: This site uses Cloudflare Web Analytics, a privacy-focused analytics service that does not use cookies and does not track individuals across sites. It collects aggregate data such as pages viewed, referring site, country, device and browser type, and page speed.
Your choices: You can block or delete cookies in your browser settings. Blocking some cookies may affect how the Services work. You can opt out of Google Analytics using Google's browser add-on at tools.google.com/dlpage/gaoptout. Where a cookie choice tool is shown on the Services, you can use it to manage optional cookies.
Global Privacy Control: If we use optional analytics or advertising cookies, we will treat a Global Privacy Control signal from your browser as a request to opt out of them.
Do Not Track: Our Services do not currently respond to "Do Not Track" browser signals, because there is no common standard for how to respond to them. We honor Global Privacy Control as described above.
3. How we may use information
We may use the information described above to:
- Respond to your messages, questions, and requests.
- Schedule and hold consultations.
- Prepare brand audits, proposals, and quotes you request.
- Provide, manage, and deliver our design, website, and marketing services.
- Run the client portal and show you the progress of your projects.
- Process payments, subscriptions, refunds, and invoices.
- Send service-related messages, such as project updates, receipts, reminders, and changes to our terms.
- Send marketing emails or messages, where allowed by law. You can unsubscribe at any time.
- Find and contact businesses and professionals who may be interested in our Services, where allowed by law.
- Remember your language and display preferences.
- Improve, test, and develop the Services.
- Understand how our website and marketing perform.
- Protect the security of the Services and prevent fraud, spam, and abuse.
- Keep business, tax, and accounting records.
- Comply with the law and enforce our agreements.
- Carry out any other purpose we describe to you when we collect the information, or with your consent.
AI tools
We may use artificial intelligence tools to help create and edit content, including images, video, text, and marketing materials, and to help run our business, such as drafting messages or organizing project information. Information and files you provide for a project may be processed by these tools to produce your deliverables. All AI-assisted work is directed and reviewed by our studio before delivery. Where these tools offer settings that limit the use of your content to train their models, we aim to use those settings. We will not use a real person's face or voice to create AI content without that person's written consent.
Face and voice data
When a project uses a person's face or voice, such as for AI video, we use it only for that person's project or plan and only with that person's written consent. When the project or plan ends, or when the person withdraws consent, we delete the original photos, video, and audio, and we delete (or ask our AI tool providers to delete, where the tool allows) any voice or avatar models made from them. We keep them longer only if the person asks us in writing to keep them for future work or if the law requires it.
4. How we may share information
We do not sell your personal information, and we do not rent or give lists of it to other businesses. If we use advertising pixels (such as Meta's), those companies may collect information directly from your browser when you visit our site and use it under their own policies. You can limit this using the choices in Section 2.
We may share information with:
- Service providers that help us run the Services and our business, such as website hosting (for example, Netlify), database and login services (for example, Supabase), scheduling (bookings are made through Google Calendar appointment scheduling, a Google Workspace service, which collects the name, email and any answers you give when booking), payment processing (for example, Stripe or Square), email delivery (for example, Resend), email and file storage (for example, Google), analytics, content delivery networks, form handling, AI tools, and design and video software. These providers may only use your information to provide services to us or as described in their own privacy policies.
- Sales and scheduling partners who help us find potential clients, contact them, and set up consultations, only as needed for that work.
- Subcontractors and collaborators who help with a project, such as printers, developers, photographers, or other creative professionals, only as needed for your project.
- Platforms you ask us to work with, such as your social media accounts, website host, domain registrar, or advertising accounts.
- Legal and safety recipients, when we believe sharing is required by law, legal process, or a government request, or is needed to protect the rights, property, or safety of Dunieski Designs, our clients, or others, including to respond to payment disputes and enforce our agreements.
- Business transfers, if Dunieski Designs is involved in a merger, sale, acquisition, financing, or transfer of all or part of the business. Your information may be transferred as part of that transaction.
- Anyone else, with your consent or at your direction.
We may also share information that has been combined or de-identified so that it no longer identifies you.
Text messages
If you agree to receive text messages from us, message frequency varies, and message and data rates may apply. Reply STOP to opt out or HELP for help. We do not sell, rent, or share your mobile phone number or your text message opt-in and consent with third parties or affiliates for their marketing or promotional purposes. All of the categories of sharing described above exclude text message opt-in data and consent. That information will not be shared with any third parties for any purpose other than delivering our messages to you.
5. Portfolio and publicity
We may show work we created in our portfolio, website, social media, and marketing, once our client has made it public or has given permission. When a client prefers not to be identified, we may change or remove names, contact details, and other identifying information. We will not publish your testimonial, name, or likeness without your permission.
6. Third-party links and services
The Services may link to or include features from other websites and services, such as scheduling pages, payment pages, social media, embedded videos, and fonts or scripts loaded from outside providers. Those third parties have their own privacy policies, and we are not responsible for how they handle your information. We encourage you to review their policies.
7. How long we keep information
We keep information for as long as we need it for the purposes described in this policy, including to provide the Services, maintain business and tax records, resolve disputes, and enforce our agreements. When information is no longer needed, we will delete it or make it de-identified, unless the law requires us to keep it longer. Some information may remain in backups for a limited time. Face and voice data is kept only as described in Section 3. If you ask us not to contact you, we keep a record of that request so we can honor it.
8. How we protect information
We use reasonable technical and organizational measures to protect information, such as secure (HTTPS) connections, access controls, and database security rules that let clients see only their own project information in the client portal. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. You are responsible for keeping access to your email account secure, since it is used to sign in to the client portal. If a security breach affects your personal information, we will notify you as required by law.
9. Your choices and rights
Depending on where you live, you may have the right to:
- Ask what personal information we have about you.
- Ask us to correct information that is wrong.
- Ask us to delete your information.
- Ask for a copy of your information.
- Opt out of marketing messages.
- Opt out of optional analytics and advertising cookies.
- Withdraw consent you have given us.
To make a request, email us at dunieski@dunieskidesigns.com. We may need to confirm your identity before completing your request. We will respond within 45 days, or sooner if required by law. We will not treat you differently for making a privacy request. We may decline requests that we cannot verify, or that are repetitive or excessive, where the law allows.
Some information may need to be kept even after a deletion request, for example to complete a transaction, meet legal or tax requirements, or protect against fraud.
Marketing messages and calls: Anyone can ask us to stop contacting them about our Services, wherever they live. You can unsubscribe from marketing emails using the link in any email. For text messages, reply STOP to opt out. To stop calls from us, tell us during the call or email us, and we will add you to our do-not-contact list. We may still send you messages about your projects, payments, or account.
Follow-up emails: If you contact us through a form, we may send you up to two follow-up emails about your inquiry. Every email has an unsubscribe link, and you can also reply stop. We send these emails through Resend, an email delivery service.
10. Children's privacy
Our website and Services are only for adults 18 and older and for businesses. They are not directed to children, and we do not knowingly collect personal information from anyone under 18. If we learn that we have collected personal information from someone under 18, we will delete it promptly.
The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13, consistent with the U.S. Children's Online Privacy Protection Act (COPPA). If you are a parent or guardian and believe your child has given us personal information, contact us at dunieski@dunieskidesigns.com and we will delete it.
11. Where information is processed
Our Services are intended for businesses and professionals in the United States. We are based in the United States, and information may be stored and processed in the United States and in other countries where our service providers operate. If you use the Services from outside the United States, you understand that your information may be transferred to and processed in the United States, where privacy laws may be different from those in your country.
12. Language
This Privacy Policy may be provided in English and in Spanish. If there is any difference between the two versions, the English version will control.
13. Changes to this policy
We may update this Privacy Policy from time to time. When we do, we will change the "Last updated" date at the top of this page. If we make significant changes, we may also notify you by email or with a notice on the Services. The updated policy applies from the date it is posted.
